Terms & Condition of SALES

Products purchased directly from BGCGallery.com. (hereinafter BGCGallery.com.) are expressly subject to and conditioned upon the terms and conditions set forth below. Any different or additional terms set forth by purchaser (hereinafter Customer), whether in Customer’s purchase order or another communication, are expressly objected to and will not be binding on BGCGallery.com. unless agreed to in writing by BGCGallery.com. executive management.

Sales and Payment Terms Unless otherwise agreed in writing and granted by BGCGallery.com., terms are cash in advance. Unless otherwise noted, shipping charges are prepaid by BGCGallery.com. using its preferred carrier for standard domestic ground service, and will be invoiced to customer. Any and all invoice errors must be disputed within 30 days of invoice date and are subject to correction by BGCGallery.com..

Limited Warranty BGCGallery.com. warranty periods may vary by product, unless otherwise published, the standard warranty period is 12 months from original date of purchase shipment (invoice date). BGCGallery.com. warrants that its products are free from defects in workmanship and materials, and will conform to BGCGallery.com. published specifications. The warranty does not cover, and BGCGallery.com. does not warrant: (1) batteries of any type used in connection with products furnished, (2) product defects or failures as a result of misuse, modifications, alterations, improper installation or maintenance, catastrophe, or failure to conform to any applicable recommendations by BGCGallery.com.., (3) products that have removal of serial numbers or any other inventory control measures or mechanisms. BGCGallery.com. disclaims and makes no implied warrantees, including the warranty of merchantability and suitability or fitness for a particular purpose. BGCGallery.com. assumes no risk and shall be subject to no liability for damages or loss resulting from the specific use or application made of the products. BGCGallery.com.’s liability for any claim, whether based on breach of contract, negligence, infringement of any rights of any party or product liability, relating to the products shall not exceed the price paid by the original purchaser from BGCGallery.com. for such products. In no event will BGCGallery.com. be liable for any special, incidental or consequential damages (including loss of use, loss of profit and claims of third parties) however caused, whether by the negligence of BGCGallery.com. or otherwise. If any product fails to meet the limited warranty, BGCGallery.com. shall, at its option, correct any such failure by repairing anydefective or damaged parts, or make available any necessary repaired or replacement parts. BGCGallery.com. reserves the right to replace any product under warranty with new, refurbished or remanufactured product. BGCGallery.com. will not be responsible for labor costs of removal or reinstallation of products. The repaired or replaced product is then warranted under the terms of the limited warranty for the balance of the term of the warranty or for 90 days, whichever is longer. For any warranty claim, contact BGCGallery.com. customer service for a return material authorization (RMA).

Return Material Authorization Contact BGCGallery.com. customer service to request authorization for a product return. If the request is approved, BGCGallery.com. will issue a return material authorization (RMA) acknowledgement number. Return the product with a signed copy of the RMA form, in the original or equivalent packaging, freight prepaid, to the designated BGCGallery.com. location, with the RMA acknowledgement number identified on the outside of the package. Do not return product for repair, replacement, credit, or restock without authorization from BGCGallery.com.. If product is returned without authorization, it may be returned (without repair) to the sender at their expense. Any and all shipping charges associated with products being returned to BGCGallery.com. for any reason, are to be assumed by, and are the full responsibility of the sender.
